Most of the item showed in TV never delivered

My wife saw the TV and liked the advertisement, so she called and the sales told her the following:

1. All sales are guarantee, one month without conditional return and refund
2. within 3 months without condition exchange
3. Everything promised be delivered, eg all the features show on the TV, and the free gift of diamond watch
4. Anything else, one phone call, the customer service will take care of the problem.

Sounds wonderful, my wife ordered the phone on the spot

When the phone delivered, the delivery boy asked for the “money BEFORE you can receive the box.”—(see the problem here, once you pay, everything else is NOT revocable)

Now the problems

1. H718 the official resolution for camera is 3.2 M pixels, but this one is 2.0M
2. Gift watch supposed to be with diamond, but NOT a single diamond (not even a fake one)
3. Speaker of the phone was very bad
4. Chip in the phone must be extremely outdated, thus the phone is very SLOW (ie press 2nd page, will take almost 1 second)
5. On TV, there was a function “Monster Bite” seemed interesting (when you touch the screen, monster image will appear) BUT nothing was on this phone
6. On the game section, it featured the very popular “Beljewel” and many others FREE game… but on the setting, most of the game are with COST (worst yet hidden cost) no sign of warning before the charge, when you press the start, a message sent back to you stating your account was charged.
7. Worst yet, some of the key pressed, did not even tell you that you were charged and signed up with monthly plan. (I believe I was charged more than 10 after a few press of buttons, this type of act would be consider illegal in Hong Kong or western countries. The act was like a deceptive practice towards the consumer)
8. I had to call my phone company to learn that I was signed up (without any knowledge on charge, plan cost, etc) on music selection (not even a SMS to informed the charge)
9. Worst yet, I have checked the functions, most of the functions were with charge, stock info, games, weather, business news, and ALL of such function CANNOT be disabled or removed. Ie, this I like a bomb, one small mistake can cause you tons of money
10. The phone was paid in cash RMB 1280 but even though my wife asked many time on the phone for the invoice, but the invoice was NOT available when they take the money, something the TAX revenue office in China should keep a close eye on.
11. Also the phone supposed to be new, however, there are some defect on the screen (not even) but when I called the customer service (摩能) in Guangzhou , Mr. 康 and later 07 (did not want to tell me the name), they all claim the phone CANNOT be returned
12. No return or exchange unless we proof to them the phone has some problems, they even give me 800 number asking me to call Hyundai for help.
13. Sales department and Customer service is separated, the sales is doing a great job in selling the phone telling consumer false information about the telephone itself, its policy in service, return and exchange while the customer service is doing a excellent in preventing the customer in exercise such rights.

I have done a study on the TV ad market in Taiwan because they have done a great job in selling the products on TV. Although there are issues relating to the problems of product but the overall market is rather healthy. On average the return ratio is about 30-40% showing the consumers are really buying and returning. In摩能’s case, I guess the Return ratio is close to 0% given the current practice (even the product is what actually described or with defects, they managed to shut the consumer out).

My understanding is, when it comes to TV shopping, most LAW requires that THE seller is obligated to honor the promises given on TV and the full refund or exchange policy is strictly executed. I have lived in the US for 7 years and I was in the retail business so this type of TV shopping is rather friendly to consumers.

I really do not care about the 1280 I have paid but I am extremely surprised about this type of practice in China given the fact that 摩能 is a sizable company selling lots of different products in different part of China. They practice is not morally acceptable and not ethical

I will still be in Shanghai for the coming week and try to see if there are government regulatory agency to oversee this TV ad area and try to put a stop on this dirty practice.
